The questioner : Some men say to their wives: "You are divorced, go to your family," over trivial matters. This phenomenon has spread in a disturbing and striking manner, and the courts are overflowing with it, as are the da'wah and guidance centers. In one statistic, the number of divorce cases reached twelve thousand, one hundred, and twenty-two cases in a single year, which is a rate of thirty-three divorce cases per day. Here are three questions. The first is: O honorable Shaykh, is there any brief advice for those who divorce over the most trivial matters?

The Shaykh : Yes. The advice is that they should fear Allah (Mighty and Majestic) and not divorce except in accordance with the Shari'ah. If a man divorces in accordance with the Shari'ah, he divorces with deliberation and insight into the matter. If he wants to divorce because he dislikes the woman, we say: Wait, for Allah says:
perhaps you dislike a thing and Allah makes therein much good. إِنْ كَرِهْتُمُوهُنَّ فَعَسَى أَنْ تَكْرَهُوا شَيْئًا وَيَجْعَلَ اللَّهُ فِيهِ خَيْرًا كَثِيرًا
[An-Nisa 4:19]
And the Prophet (peace and blessings be upon him) said:
A believing man should not hate a believing woman لا يفرك مؤمن مؤمنة

meaning: he does not hate her.
if he dislikes one of her characteristics, he will be pleased with another. إن كره منها خلقاً رضي منها خلقاً ءاخر

And he advised well regarding women and said:
They were created from a rib, and the most crooked part of the rib is its top. If you try to straighten it, you will break it, and if you enjoy it, you will enjoy it while it is crooked إنهن خلقن من ضلع، وإن أعوج شيء في الضلع أعلاه، فإن ذهبت تقيمها كسرتها، وإن استمتعت بها استمتعت بها على عِوج
It is not possible for a man to find a wife who does not oppose him in every matter; rather, what is lacking in this one is present in the other. Moreover, in the present time, when does a man find a wife? He may knock on many doors and not be answered. Then, if he is answered, when does he find the money sufficient for the expenses of marriage? So if he is determined to divorce, we say: Wait, is the woman pregnant? If he says: Yes, we say: There is no harm, divorce, for the divorce of a pregnant woman is effective, and her waiting period ends when she gives birth. If he says: She is menstruating, we say: Wait until she is purified from menstruation, then divorce. If he says: She is pure, we look to see if she is one who menstruates, or if she is a young girl who has not started menstruating, or an old woman who has despaired of menstruation. If he says: She is one who menstruates, we say: Did you have intercourse with her after she was purified from her previous menstruation? If he says: Yes, we say: Wait until she menstruates or her pregnancy becomes apparent. If she menstruates, wait until she is purified, then divorce. If her pregnancy becomes apparent, divorce. If he says: I did not have intercourse with her in this period of purity, we say to you: Do not divorce. The matter requires deliberation and conditions and restrictions.
This is my advice to every person. As for what some foolish people do, where as soon as his wife opposes him in the most trivial things he says "divorce," or when his companion opposes him in the most trivial things he says "my wife is divorced if you do not do such and such," this is a great error. It is obligatory to deliberate and consider until his opinion settles on something. Yes.
