Is it permissible for the heirs to take the *khuraj* after the death of their deceased, given that it was being paid to him during his lifetime?

Machine translationRead the Arabic original
The questioner : Your Eminence, the Shaykh

The Shaykh : Yes, ask.

The questioner : I have a relative who passed away, and I extracted [the document]. He had a *khuraj* [payment] after he died. The *khuraj* agent presented a copy of the document regarding his right, and I extracted a *khuraj* payment for him from the *khuraj* fund, even though he was deceased. What is the ruling on this matter? He was not alive, but the *khuraj* payment came out after he died. He was the owner of the *khuraj*, and now the heirs are receiving the *khuraj*. What is the ruling on that, O Shaykh?

The Shaykh : What occurred before he died is considered part of his estate; it is added to the estate and distributed according to the laws of inheritance. As for the future, it is obligatory to inform the responsible authority that the man to whom this *khuraj* is being paid has died, and then the authority will handle the matter.

The questioner : But O Shaykh, you know that the *khuraj* continues for every deceased person.

The Shaykh : No, I do not know that. I know that it continues until the person dies, and when he dies, a new arrangement must be made.

The questioner : Okay, O Shaykh, and what is the solution now?

The Shaykh : The solution is to inform the responsible authorities, saying, "The man died such-and-such a year ago." Do not let your food be doubtful; make your food good. Do not be in danger regarding food, which is the nourishment of the soul, not just the body. It is better for a person to eat tree bark and the plants of the earth than to eat a single dirham that is *haram* (forbidden).

The questioner : May Allah reward you, O Shaykh.

The Shaykh : And you likewise.
