Q: I own a shop in my father’s inheritance, and I had not taken it before, but I was able to obtain it recently. It has been owned by a tenant for years. Can I evict him from the shop now that it has become my property? And if the opposite is the case, can I accept a specific sum of money from him as a symbol for handing over the shop, known in Algeria as al-muqna'? And can I sell it to him?
A: What your father left of real estate and other assets belongs to his lawful heirs after settling his debt, if there is any, and executing his lawful bequest. It is the right of the heirs to dispose of what has devolved to them from their deceased by sale, lease, or other forms of lawful disposal.
