A man sowed seeds, is it permissible for him to kill the birds that fall upon them?

Machine translationRead the Arabic original
The questioner : In the name of Allah, the Most Gracious, the Most Merciful. All praise is due to Allah, Lord of the worlds, and may peace and blessings be upon our Prophet Muhammad, and upon his family and all his Companions.
As for what follows: The question revolves around a man who sowed seeds and watered them, and birds came to eat them. Does he strike the birds?

The Shaykh : Yes?

The questioner : Does he strike the birds and leave the seeds?

The Shaykh : Yes, meaning a man sowed seeds and the birds took control of them.

The questioner : He watered them with water.

The Shaykh : He watered them with water and the birds took control of them. Is it permissible to kill the birds? The answer: Yes, it is permissible to kill the birds to repel their harm. And anything that is harmful and cannot be repelled except by killing it, you may kill it, whether it is birds or other things. Even if a person attacks another person to kill him, or to take his money, or to violate his honor, and it cannot be repelled except by killing, then he may kill him.

The questioner : May Allah reward you with good.

The Shaykh : Yes. If someone asks: What is the evidence in the matter of a person? The evidence is that it is established from the Prophet (peace and blessings be upon him)
A man asked him, saying: O Messenger of Allah, what do you think if a man comes asking for my wealth? He said: Do not give him your wealth. أن رجلًا سأله قال: يا رسول الله أرأيت إن جاء رجل يطلب مالي قال: لا تعطيه مالك
Do not give him your wealth
He said: What do you think if he fights me? He said: Fight him. He said: O Messenger of Allah, what do you think if I kill him? He said: He is in the Fire. He said: O Messenger of Allah, what do you think if he kills me? He said: Then you are a martyr. قال: أرأيت إن قاتلني، قال: قاتله، قال: يا رسول الله أرأيت إن قتلته؟ قال: هو في النار، قال: يا رسول الله أرأيت إن قتلني؟ قال: فأنت شهيد
but on the condition that it cannot be repelled except by killing. As for if it can be repelled without killing, then it is not permissible for you to kill him. For example, if you are active and strong, stronger than he is, and you can hold him and capture him and be safe from his evil, it is not permissible for you to kill him, because the harm is repelled by the easiest means.
