The second question of Fatwa No. ( 4013 )
Q2: Is it permissible to kill birds that Allah has made lawful to eat while they are nesting ? And is it permissible to take their young in front of them?
A2: It is not permissible to kill what Allah has made lawful except by slaughter, or by the ritual slaughter of camels, or by hunting in the lawful manner; so that it may be eaten, or sold, or given as a gift to one who will eat it. As for killing it merely for play and amusement, that is prohibited; because of the waste of wealth involved, along with the torture
of the animal. The Prophet (peace and blessings be upon him) forbade that. Likewise, it is forbidden to take an animal, such as a bird or similar creature, as a target for practicing archery; because of what is established fromRiyad as-Salihin 758 . As for taking young birds whose meat is edible from their nests; to be slaughtered and eaten after they have reached a size suitable for consumption, there is nothing wrong with that. As for taking them for play and amusement, that is not permissible for the reasons mentioned above. Likewise, it is not permissible to kill their mothers, or to take them alive along with their young, which are small and need the care of their mothers. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
