Is it permissible for a man who has married a second wife, when the first wife went to her father's house and stayed there for a month in anger, to spend the night with the second wife on the night of the absent first wife?

Machine translationRead the Arabic original
The questioner : In the name of Allah, the Most Gracious, the Most Merciful.
His EminenceThe Shaykh : A man is married to two wives. One of them got angry and went to her family's house. In this situation, should he spend the night in the house where no one is, or should he go to the second wife?

The Shaykh : How did you understand that?

The questioner : A man is married to two wives.

The Shaykh : Did he marry one wife on top of another, or are they in one contract?

The questioner : No, no.

The Shaykh : Huh?

The questioner : He is married to two wives.

The Shaykh : Do you mean a previous wife?

The questioner : Yes.

The Shaykh : So he married another one.

The questioner : Yes.

The Shaykh : Did the second one get angry, or the first one?

The questioner : The first one got angry, went to her house, and stayed for a month. And now, in this situation, he used to sleep in the mosque; he would not come to her night, but would sleep in the mosque.

The Shaykh : No, no, he does not sleep in the mosque.

The questioner : Does he go to the new one?

The Shaykh : Yes, he goes to the new one, because the first wife is the one who dropped her right. She has no right to leave her husband's house simply because he married, for he did not do anything wrong; rather, he did good. Because if a person is able with his wealth, able with his body, and able with his judgment, it is better for him to marry up to four if he is able. Being able with his body means he is active and can fulfill the specific right of the two women. Being able with his wealth means he can provide for them. Being able with his judgment means he can be just between them. So let him marry; the more women there are, the better it is. Ibn Abbas (may Allah be pleased with him and his father) said: "The best of this nation are those who have the most women". So the woman who gets angry and goes to her family when her husband marries another is the one who dropped her right of rotation. So he remains with the second one all the nights, and whenever that one wants, she comes. Yes.
