The questioner : And she is dutiful to him, saying that at times she takes a small amount from his money, ten or twenty riyals, and gives it in charity to some of her children and others, intending thereby to give charity on his behalf. Does she incur sin for this?

The Shaykh : Yes, she incurs sin for this, because no one has the right to give away another person's money. Her father's money belongs to him, and it is not permissible for her to touch it except in the best manner. She must also obtain a power of attorney from the judge; I mean a guardianship. She must obtain guardianship over her father's money from the judge. She might say, "My father has no heir other than me." We say, "No, that is not correct. You have no right to your father's inheritance except half, and the rest is for the residuary male heirs. And who knows, perhaps she will die before her father, in which case her father would inherit from her. Therefore, I tell her that what she has taken from her father's money in the manner you described is not permissible for her, and she will not be free of liability except by returning what she took to her father's money. Yes.
