The Shaykh : There is a hadith about it, but it is weak.

The questioner : Is that so, Shaykh?

The Shaykh : Yes, but it is weak. The correct view is that the Hajj is valid, but with sin. Yes. Now, we mentioned that if he needs to do a prohibited act, he does it and he owes the expiation, and we cited evidence from the Qur'an in the story of shaving the head. But if he needs to eat and there is a gazelle in front of him, is it permissible for him to slaughter the gazelle to save his life, or is it not permissible?
The student: It is permissible.

The Shaykh : Yes, it is permissible, because if a person is in dire necessity for a forbidden thing, it becomes permissible for him. Now, if it is permissible, does he owe the penalty or not? Some scholars said he owes the penalty because he hunted it for himself, so he owes the penalty. Others said he does not owe a penalty because Allah made it lawful, so it now has no sanctity. This is closer to the truth, and the first view is more cautious. Now, suppose he has a live rabbit and a dead rabbit, and he is in the state of ihram. What does he do? Does he eat the dead one or not eat the live one?
The students: The live one.

The Shaykh : The live one. Yes, the correct view is that he eats the live one. Some scholars say he eats the dead one, especially according to those who hold that if he eats the live one, the expiation or the penalty becomes obligatory upon him. But the correct view is that he eats the live one. Now, suppose he has a live rabbit, a dead rabbit, and a live cat. Which one?
The students: The live rabbit.

The Shaykh : The live rabbit. Correct. May Allah reward you. May Allah hear.
