The reader: Asbagh narrated to us, saying: Ibn Wahb informed me, from Yunus, from Ibn Shihab, from 'Ali ibn Husayn, from 'Amr ibn Uthman, from Usamah ibn Zayd (may Allah be pleased with them both):
That he said: O Messenger of Allah, where will you stay in your house in Makkah? He said: And did 'Aqil leave us any gardens or houses? 'Aqil and Talib had inherited from Abu Talib, but Ja'far and 'Ali (may Allah be pleased with them both) did not inherit anything from him, because they were Muslims, while 'Aqil and Talib were disbelievers. 'Umar ibn al-Khattab (may Allah be pleased with him) used to say: A believer does not inherit from a disbeliever. أنه قال يا رسول الله أين تنزل في دارك بمكة فقال وهل ترك عقيل من رباع أو دور وكان عقيل ورث أبا طالب هو وطالب ولم يرثه جعفر ولا علي رضي الله عنهما شيئاً لأنهما كانا مسلمين وكان عقيل وطالب كافرين فكان عمر بن الخطاب رضي الله عنه يقول لا يرث المؤمن الكافر

The Shaykh : Meaning, he is explaining the saying of the Messenger (peace and blessings be upon him):
Has 'Aqil left for as any land or house? وهل ترك لنا عقيل من رباع أو دور

A Muslim may not inherit from an infidel nor an infidel from a Muslim. لا يرث المسلم الكافر ولا الكافر المسلم
