Explanation of the Book of Foods-05a

Machine translationRead the Arabic original
The reciter: Adam narrated to us, Shu'bah narrated to us, Jabalah ibn Sahim narrated to us, saying:
We were struck by a year of famine with Ibn al-Zubayr, and we were granted dates. Abdullah ibn Umar would pass by us while we were eating and say: "Do not pair them, for the Prophet (peace and blessings be upon him) forbade pairing," then he would say, "Except if a man asks his brother's permission."
Shu'bah said, "The permission is from the statement of Ibn Umar."

The Shaykh : Yes, pairing in dates and the like of what is customarily eaten individually is forbidden if you are with others, because this restricts the others. But if you are alone, there is no harm. Our statement "of what is customarily eaten individually" excludes what is customarily eaten paired, for which there is no harm. For example, pomegranate seeds are eaten paired, and there is no harm. Grapes differ, one by one, and dates are also customarily eaten individually. So if you are with someone, do not eat individually, especially if it is a year of famine, meaning a time of scarcity, so do not eat individually, because this leads to... Yes, do not eat paired, because this leads to encroaching on your brother's right. And because if you eat paired and pair two, your companion will pair three, then you will pair four, and so on.

The questioner : And if there is a lot

The Shaykh : Even if there is a lot, the best is not to pair as long as you are with someone. And the statement of Ibn Umar:
Except if he asks his companion's permission. إلا أن يستأذن صاحبه
indicates that he (may Allah be pleased with him) understood that this is for the sake of his companion's right, not that it is disliked in itself, but rather for the sake of his companion's right. Yes, that is correct.
