Explanation of the Book of Foods-06b

Machine translationRead the Arabic original
The reader: Abu Nu'aym narrated to us, Zayd narrated to us from 'Amir from 'Ubayd ibn al-Hatim (may Allah be pleased with him), who said:
I asked the Prophet (ﷺ) about the game killed by a Mi'rad (i.e. a sharp-edged piece of wood or a piece of wood provided with a sharp piece of iron used for hunting). He said, "If the game is killed with its sharp edge, eat of it, but if it is killed with its shaft, with a hit by its broad side then the game is (unlawful to eat) for it has been beaten to death." I asked him about the game killed by a trained hound. He said, "If the hound catches the game for you, eat of it, for killing the game by the hound, is like its slaughtering. But if you see with your hound or hounds another dog, and you are afraid that it might have shared in hunting the game with your hound and killed it, then you should not eat of it, because you have mentioned Allah's name on (sending) your hound only, but you have not mentioned it on some other hound. سألت النبي صلى الله عليه وسلم عن صيد المعراض قال : ما أصاب بحده فكله وما أصاب بعرضه فهو وقيذ ، وسألته عن صيد الكلب فقال : ما أمسك عليك فكل فإن أخذ الكلب ذكاة وإن وجدت مع كلبك أو كلابك كلباً غيره فخشيت أن يكون أخذه معه وقد قتله فلا تأكل فإنما ذكرت اسم الله على كلبك ولم تذكره على غيره
Sahih al-Bukhari 5475

The student: Zayd

The Shaykh : With the hamzah, there is no harm, it is all one. Now, he says "hunting with a trap." A trap is something like a stick with a pointed thing on its head. He says:
If the sharp edge hits (the game), then eat, but if the broad edge of it strikes it, then it has been killed by a blow. ما أصابه بحده فكل وما أصاب بعرضه فهو وقيذ فلا تأكل
Sunan an-Nasa'i 4308Sahih (Darussalam)
If it strikes with its point, meaning you hit it with it like this and it strikes with its point, eat it, because it breaks the flow of blood. And if it strikes with its side, do not eat it, even if it dies, because it did not break the flow of blood, so it is carrion. Likewise, he asked him about hunting with a dog, and he said:
If the hound catches the game for you, eat of it, for killing the game by the hound, is like its slaughtering. ما أمسك عليك فكل فإن أخذ الكلب ذكاة
Sahih al-Bukhari 5475
Here he said:
Whatever it holds for you ما أمسك عليك
meaning for you, unlike if it holds it for itself. The sign of that is that it eats from the prey. If it eats from the prey and brings you what remains, that is evidence that it only held it for itself. And if it did not eat and brought it to you whole, that is evidence that it only held it for you, so eat it. Then he mentioned that if you find another dog with it, you do not eat it, due to the possibility that the other dog is the one that killed it. For this reason he said:
and you fear that that dog (the second one) had caught it (the game) along with that (your dog) and killed it. then don't eat فخشيت أن يكون أخذه معه وقد قتله فلا تأكل
Sahih Muslim 1929f
Why? Because we are in doubt about the permissibility; we do not know whether the dog over which you mentioned the name is the one that hunted it, or the other dog. And his saying:
and killed it وقد قتله
this has a concept, which is that if it did not kill it and you caught it while it was still alive and you slaughtered it, it is lawful. Then the Messenger (peace and blessings be upon him) explained the reason for not eating when another dog is found that you fear held it with yours, by saying that you only mentioned the name over your dog and did not mention it over the other. From this it is known that if the dog runs loose by itself without you mentioning the name over it, what it hunts is not lawful, even if it hunted it for you, if it brought it to you and you did not send it and did not mention the name of Allah over it, do not eat it. Yes.

The questioner : ... you sent two ...

The Shaykh : This is a question from 'Aliyan, three, what? It counts, this counts as two questions, yes.
