Benefits of the Hadith of the Slave Girl Slaughtering the Sheep
Machine translationRead the Arabic original
The Shaykh : As you have seen, these hadiths contain several benefits. Among them is the permissibility of a woman tending sheep, because the Prophet (peace and blessings be upon him) approved of it. However, this is conditional on being safe from fitnah (trial, discord or temptation) and aggression against her. If we are in a land where we do not feel safe from that, then it is not permissible to make her a shepherd. So, Ahmad, among the benefits is also the permissibility of a woman performing the ritual slaughter, as al-Bukhari titled a chapter for this, because the Prophet (peace and blessings be upon him) ordered them to eat it. Among them is the permissibility of the ritual slaughter performed by a menstruating woman, because the Messenger (peace and blessings be upon him) did not inquire whether the woman was menstruating or not, even though the possibility of her being menstruating is close and likely. They said that from this is derived the permissibility of the ritual slaughter performed by one in a state of major ritual impurity (janabah), because if it is permissible for a menstruating woman, then one in a state of major ritual impurity is even more so. There is some consideration regarding this analogy, but the original ruling for the ritual slaughter of one in a state of major ritual impurity is that it is lawful. Among them is the permissibility of a person disposing of another person's property for its benefit, because this slave girl, what did she do? She disposed of this flock by slaughtering the sheep that was dying for the sake of benefit, and that is the case. In this situation, if the owner were to reject what this benefactor did, it would not be accepted. If he said, "Why did you slaughter it? You should have kept it until it died," we would say, "We do not reject that. We do not reject this action, because his action was one of reform and kindness. And Allah the Exalted said: [At-Tawbah 9:91] And you only said, 'If you had left it,' but your aim was not reform, but rather to harm this benefactor, so we do not accept his objection. Among them is the permissibility of ritual slaughter with a stone, because the Messenger (peace and blessings be upon him) approved of it and said: . Among them is that a person who is qualified to dispose of property is not asked about the manner of his disposal. For this reason, the Messenger (peace and blessings be upon him) did not ask whether she mentioned the name of Allah (Mighty and Majestic), or whether she cut the two windpipes, or the like, relying on the fact that the original state is safety and soundness. Good. Among them is also the acceptance of the statement of a trustworthy person regarding what he is entrusted with. The reason for this is that this woman said she saw death in it, and they did not ask her to present proof. They did not say, "Where is the proof for that?" Among them is the scrupulousness (wara') of the Companions (may Allah be pleased with them), where they refrained from eating until they asked the Messenger of Allah (peace and blessings be upon him). Yes.
