Chapter: What is driven from among the livestock is in the position of wild game.

Machine translationRead the Arabic original
The reciter: Chapter: What is driven from among the livestock is in the position of wild game. Ibn Mas'ud permitted it, and Ibn Abbas said, "What is more weak among the livestock than what is in your hands? It is like game." And regarding a camel that falls into a well, he said, "Wherever you are able to reach it, slaughter it." Ali, Ibn Umar, and Aishah held this view.

The Shaykh : Yes, this is also for what one is unable to slaughter or perform the ritual slaughter upon; it becomes lawful by striking it in any part of its body, whether it is fleeing or has fallen into a distant place that we cannot reach, such as a well or a mountain ravine. In such a case, it is shot at just as game is shot at, and wherever the arrow strikes its body, it becomes lawful. If someone asks, "What is the limit? Do we say, 'Wait until you go and come back with a knife and descend into the well,' when it may die during that time, as is usually the case, especially if it has fallen by its neck? Or do we say there is no harm in sending an arrow at it now, fearing that it will be lost and its sanctity violated?' The answer is the second option. We do not tell a person, 'Do not take the knife and descend.' If he does that, the animal will die. Rather, I say, as long as I am unable to preserve its life except by this action, I am permitted to do so, and it becomes lawful in any part of its body. Its ruling is the ruling of game, based on the transmitted report that passed us previously, and based on correct analogical reasoning, because the exemption from ritual slaughter in the case of game is because it is not possible to slaughter it.
