The questioner : The honorable Shaykh, a man married off his daughter to another man and conditioned upon him that he perform Hajj with her. After that, this daughter died, and her husband did not perform Hajj with her. So the father took money from the husband to perform Hajj on her behalf. After a period, the father died and did not perform Hajj either. Now his son is asking: Should I perform Hajj on behalf of my father to clear his conscience, or what should I do?

The Shaykh : On behalf of his father, or not?

The questioner : On behalf of his father.

The Shaykh : Or on behalf of his daughter, his sister?

The questioner : I mean, on behalf of his father, to clear his father’s conscience, because his father intended to perform Hajj on behalf of his sister.

The Shaykh : He took the money from the husband to perform Hajj with it. He should perform Hajj on behalf of his father, and this is obligatory from his father’s estate, and it is a debt upon his father, a debt upon his father. If he volunteers and performs Hajj from his own funds, saving the money for the heirs, there is no harm.

The questioner : May Allah reward you with good.

The Shaykh : Yes.
