The Shaykh : It is a custom that they gather when the deceased dies, reciters are brought in, the wailers wail, they tear their garments, and they gather forty days after his death, and on every Thursday. What is the ruling on that?
And how does one who does not want such a thing done for him clear his conscience?
And is he obligated to forbid them from doing so in his will? May Allah grant success.
Well, first of all: there is no doubt that this is wrong and that it is of the forbidden wailing. The Prophet (peace and blessings be upon him) cursed the wailer and the one who hires her, and said:
If the wailing woman does not repent before she dies, she will be made to stand on the Day of Resurrection wearing a garment of pitch and a chemise of mange. النّائحة إذا لم تتب قبل موتها تقام يوم القيامة وعليها سربال من قطران ودرع من جرب
Sahih Muslim 934
It is among the major sins. So it is obligatory to shout at these people at the top of one's voice that this is forbidden and is among the major sins. Yes, and in it is also objection to the Lord (Mighty and Majestic) by tearing garments, as well as what is held on every Thursday or on the fortieth day. And whoever knows that this is the custom of his family, let him make a will that it not be done. I think the heirs will respect this will, and it will be an opening of good, that people will abandon it.
