The questioner : I had a dispute with a man and we went to court. He was asked to take an oath, so he swore falsely. What is the reckoning for one who swears by the Qur'an while lying?
The Shaykh : If a person swears in a lawsuit about something in which he is lying, that is the oath of perjury (al-yamin al-ghamus). It is established from the Prophet (peace and blessings be upon him) that:Sunan Ibn Majah 2323Sahih (Darussalam) It is called "ghamus" (perjury) because it plunges its owner into sin and then plunges him into the Fire. It is the same whether he swears on the mushaf or without it.
Moreover, swearing on the mushaf is a matter that was not known in the time of the Prophet (peace and blessings be upon him) and his Companions, as far as we know. However, some people adopt it as a means of emphasis and intimidation. In any case, whoever claims a claim that is not his, or denies something that is his, and swears to it while lying, his reward is this reward that you have heard: he will meet Allah the Exalted while He is angry with him. May Allah protect us and our Muslim brothers from His anger and punishment.
The questioner : O Allah, amen. May Allah bless you.
