Answer: It is not permissible to swear by other than Allah in a lie, nor to joke in that regard. If it concerns wealth that he takes, it becomes greater. The Prophet (peace and blessings be upon him) said:Bulugh al-Maram 1426. The scholars call the false oath the "ghumus oath" because it plunges its owner into sin and then into the Fire. Therefore, it is not permissible for a believer to swear in a lie; rather, he must seek truthfulness. The Prophet (peace and blessings be upon him) said: Sunan Ibn Majah 2101Da'if (Darussalam), ... one must seek truthfulness, except if he is wronged and forced to speak other than the truth, such as if someone says: "Swear by Allah that you did not kill so-and-so," or "that you did not wrong so-and-so," or the like. If he swears by Allah that he did not kill so-and-so or did not wrong so-and-so, and he is lying in this because he did kill him, but he killed him with a right, or took his wealth with a right, not killing him unjustly and not taking his wealth unjustly, but taking wealth with a right in buying and selling, or killing him with a right of retaliation or the like of a right, then the point is that if he is forced to take an oath and he is in his own heart in the right, but he swears to escape their evil, that does not harm him. His lie in it is because in reality he is not a liar; he did not kill him in the way they said, but he killed him or took the wealth in another valid way. Likewise, if he swears by Allah in a lie to save his brother from evil, such as if they want to kill him without a right, he swears by Allah that he is his brother or that he is his relative to save him from the evil of these oppressors, then there is no harm in that.
