The Shaykh : In this hadith is evidence for the obligation of avoiding fitnah (trial, discord or temptation) and what leads to it. This is indicated by the saying of Allah the Exalted:
In it is evidence for acting upon circumstantial evidence. Acting upon circumstantial evidence is established. Acting upon circumstantial evidence falls under acting upon suspicion, but it is a suspicion based on circumstantial evidence, so it is not a sin. For this reason, the expression in the Noble Qur’an is:[Al-Hujurat 49:12] He did not say “all suspicion,” and He did not say “avoid all suspicion,” because some suspicion is based on circumstantial evidence and is acted upon. So this is circumstantial evidence that was acted upon. This benefits a person in judging people, whether in the field of judgment, or in the field of transactions, or otherwise. It is not hidden from us the story of the judge who judged regarding the wife of al-Aziz (the Minister). He judged by circumstantial evidence. The Prophet (peace and blessings be upon him) said: When were the Banu Nadir expelled from Madinah? How could it be exhausted, meaning consumed by wars? And the wealth is much. Then he handed him over to al-Zubayr ibn al-Awwam (may Allah be pleased with him) and said to him: “Strike him until he indicates to us the place of the wealth.” When he touched him with punishment, he said: “Wait, I see Huyayy ibn Akhtab hovering around a ruin here in Khaybar, a ruined place, meaning collapsing dwellings or the like.” So he indicated to them this place, and they found that the great, abundant gold wealth had been buried there. So acting upon circumstantial evidence is permissible, or not? It is permissible, to the extent that the Messenger of Allah tortured him. He said to al-Zubayr: “Touch him with punishment until you torture him.” So this is also acting upon circumstantial evidence.

إِن كانَ قَميصُهُ قُدَّ مِن قُبُلٍ فَصَدَقَت وَهُوَ مِنَ الكاذِبينَBut if his shirt is torn from the back, then she has lied, and he is of the truthful."
