The Shaykh : In this is evidence that if a man finds a man committing zina with his wife, he has the right to strike him, and he has the right to kill him without warning, because this is not from the category of repelling an aggressor where we would say to warn him first, but it is from the category of disciplining the transgressor. And his saying: "not with a sheathed sword" means that I strike him with the edge of the sword in order to amputate and cut him off. The Prophet (peace and blessings be upon him) did not rebuke Sa'd for this, but rather he made it one of his virtues, where he said:
Do you wonder at Sa`d's sense of ghira أتعجبون من غيرة سعد

. And this occurred in the time of the Commander of the Faithful, 'Umar ibn al-Khattab (may Allah be pleased with him). A man came and entered his home and found a man committing zina with his family, and I seek refuge in Allah, so he took the sword and cut the man in two. The husband took the sword and cut the man in two. Then they referred the matter to 'Umar ibn al-Khattab (may Allah be pleased with him). They said, "Yes, they admitted that the man committed zina with his wife." So 'Umar took the sword and shook it and said: "If they return, then return". This is an application of the hadith mentioned. However, if he sees him in a state other than this, such as seeing him mixing with her, or kissing her, or something similar, it is not permissible for him to kill him, but he has the right to refer him to the one in authority. And if the man attacks him, he has the right to defend himself. If he cannot be repelled except by killing him, then he has the right to kill him. Yes.
