You stated in a fatwa of yours that for one who has a major ritual impurity and fears missing the prayer, it is better and more preferable to repeat the prayer after performing ablution. So, if he does not repeat it, is his prayer valid?

The questioner : Shaykh, may Allah forgive you: In the last monthly session, I was asked about a man who stood up for the Fajr prayer while in a state of major ritual impurity. He feared missing the congregational prayer, so he performed ablution and then prayed. When I was asked about that, I said: It is more preferable and more befitting to repeat the prayer, and he is in a state of ablution... He had major ritual impurity before that, which is a major state of impurity. Does your saying "it is more preferable and more befitting" mean that he is not obligated to repeat the prayer and that his conscience is cleared in that regard?

The Shaykh : Perhaps he was ignorant of the ruling and was unable to repeat the prayer. I do not recall the question that was asked right now, but it is possible to review it on the tape if it was last Thursday. Perhaps the question was not as it is described now.

The questioner : The monthly session.

The Shaykh : The monthly session. Well, regarding Brother Musa, in the last month? Perhaps the question matches the answer, and perhaps it was due to his ignorance.

The questioner : Is it dropped from him?

The Shaykh : If he was ignorant, the correct view is that ignorance excuses its owner, provided he was able to ask but did not ask. He is excused in that, just as the Prophet (peace and blessings be upon him) excused the one who performed his prayer incorrectly and did not order him to make up the prayers he had missed. And just as he excused the woman who had irregular non-menstrual bleeding and used to leave off the prayer. And just as he excused 'Ammar ibn Yasir when he rolled in the dust, thinking that this was what was obligatory for him in dry ablution with clean earth. There are many proofs for this.
