The questioner : The Fajr prayer.

The Shaykh : If a person misses the night prayer and makes it up during the day, he makes it up aloud. If he misses the daytime prayer and makes it up at night, he makes it up quietly. The evidence for this is the verbal and practical Sunnah.
As for the verbal evidence: The Prophet (peace and blessings be upon him) said:
Whoever sleeps through a prayer or forgets it, let him pray it when he remembers it. من نام عن صلاة أو نسيها فليصلها إذا ذكرها
This refers to the forgotten prayer or the one missed due to sleep. When we pray it, we pray it as it was originally. So if a person sleeps through the Fajr prayer, for example, and does not get up until after the sun has risen, we say: If you are in a congregation, recite aloud.
As for the practical Sunnah: There is a hadith about the Companions sleeping with the Messenger of Allah (peace be upon him) during a journey and missing the Fajr prayer, where the sun was what woke them up. The Prophet (peace be upon him) ordered them to move from that place and said:
This is the place where we encountered Satan. Then they descended, and the Prophet (peace and blessings be upon him and his family) prayed with them as he used to pray every day. هذا موضع حضرنا فيه الشيطان، ثم نزلوا فصلى بهم النبي صلى الله عليه وعلى آله وسلم كما كان يصلي كل يوم
This indicates that he recited aloud. So the rule is now: If one makes up a night prayer during the day, what does he do? Yes? He recites aloud. And if he makes up a daytime prayer at night, he recites quietly.
