The first question of Fatwa number ( 20269 )
Q1: Is the night prayer performed aloud or silently , and how many rak'ahs does it consist of, what is the supplication recited in it, and what is the time in which it is performed?
A1: The original ruling for the night prayer is that it is performed aloud, so it is recommended for one who prays voluntary prayers to recite aloud, unless someone is harmed by his recitation. If someone is harmed by his loud recitation, such as disturbing someone praying near him or the like, then it becomes more emphasized for him to recite silently. There is no specific limit for the voluntary night prayer, so he may pray as many voluntary prayers as he wishes; for what is authentic from the Prophet (peace and blessings be upon him) that he said:Sunan Abi Dawud 1326Sahih (Al-Albani) , narrated by al-Bukhari and Muslim from Ibn 'Umar (may Allah be pleased with them both), and what is authentic from the Prophet (peace and blessings be upon him) from the hadith of 'A'ishah (may Allah be pleased with her) who said: , agreed upon by al-Bukhari and Muslim. This is the predominant practice of his (peace and blessings be upon him), and it is established that he (peace and blessings be upon him) prayed less than that and more than that, and he did not exceed thirteen rak'ahs, and he (peace and blessings be upon him) did not set a limit in that regard. The time for voluntary night prayer is the entire night, so the whole night is a place for prayer, and the night ends with the rising of the second dawn. However, the time for the witr prayer does not begin until the Muslim has prayed the 'Isha' prayer, and it extends until the rising of the second dawn. The tahajjud and witr in the last third of the night are better if it is easy for him to do so, but if he fears that he will miss it due to sleep or otherwise, he should pray as many voluntary prayers as he wishes and perform witr in the first part of the night before he sleeps. He should supplicate in his prayer, especially during the time of prostration, with whatever he loves of the good of this world and the Hereafter, and he should persist in supplication to Allah, humbling himself before Him and being humble in his supplication, so that perhaps Allah will accept from him and respond to his supplication. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.

Prayer during the night should consist of pairs of rak'ahs, but if one of you fears the morning is near he should pray one rak'ah which will make his prayer an odd number for him.
صلاة الليل مثنى مثنى فإذا خشي أحدكم الصبح صلى ركعة واحدة توتر له ما قد صلىHe (peace and blessings be upon him) used to pray ten rak'ahs, saying the closing salam after every two, and he would perform witr with one rak'ah.
كان صلى الله عليه وسلم يصلي عشر ركعات يسلم من كل اثنتين ويوتر بواحدة
