Some cited the statement of the Bedouin, “Judge between us by the Book of Allah,” as evidence that the Qur'an is what we are to refer to for judgment, not the Sunnah. What is the answer?

The questioner : Some in this era have cited [this] as evidence that one should refer to the Book for judgment, not the Sunnah. They said: A Bedouin came and said, “O Messenger of Allah, judge between us by the Book of Allah.” So they claimed that the Qur'an is what one refers to for judgment.

The Shaykh : Are you certain? Read the statement of Allah the Exalted:
It is He who has sent down to you, [O Muhammad], the Book هو الذي أنزل عليك الكتاب
[Ali 'Imran 3:7]
in Surat al-Imran. Read it.

The questioner :
It is He who has sent down to you, [O Muhammad], the Book; in it are verses [that are] precise - they are the foundation of the Book - and others unspecific. As for those in whose hearts is deviation [from truth], they will follow that of it which is unspecific, seeking discord هو الذي أنزل عليك الكتاب منه آيات محكمات هن أم الكتاب وأخر متشابهات فأما الذين في قلوبهم زيغ فيتبعون ما تشابه منه ابتغاء الفتنة
[Ali 'Imran 3:7]
.

The Shaykh : This verse applies to those people. Do you understand? To what is the doubt referred back? To the clear verses. So,
And if you disagree over anything, refer it to Allah and the Messenger فإن تنازعتم في شيء فردوه إلى الله والرسول
[An-Nisa 4:59]
And in the two Sahihs, it is narrated from A'ishah that the Prophet (peace and blessings be upon him) said:
When you see such verses, avoid them, for it is they whom Allah has pointed out (in the mentioned verses). إذا رأيتم الذين يتبعون ما تشابه منه فأولئك الذين سمى الله فاحذروهم
Sahih Muslim 2665
