The third question of Fatwa No. ( 6310 ):
Q3: A man says: "There is no god but Allah," and he does not call upon anyone other than Allah (Mighty and Majestic), nor does he place his reliance on anyone other than Allah (Mighty and Majestic). However, he refers to other than Allah (Mighty and Majestic) and His Messenger (peace and blessings be upon him) for judgment, and he calls people to join political parties, defends the parties, and claims that religion is in the heart, in prayer, fasting, zakah, Hajj, and loving people. He says that unity between the Jews and the Christians and the Muslims is necessary, and he treats a Muslim like a Christian. They make the basis of division among people: is he Egyptian or not? What is the ruling on one who refers to man-made laws while knowing their invalidity, yet does not fight them or work to remove them? And what is the ruling on one who shows loyalty to a mushrik (one who associates partners with Allah) and lives with him, while he reads Ibn Taymiyyah's (may Allah have mercy on him) statement that whoever sharpens a pen for them or provides them with paper is one of them? That man claims he hates them in his heart, but he displays the opposite of what he claims to hold in his heart regarding them. What is his ruling?
A3: It is obligatory to refer to the Book of Allah and the Sunnah of His Messenger (peace and blessings be upon him) in cases of disagreement. Allah the Exalted said:
And if you disagree over anything, refer it to Allah and the Messenger, if you should believe in Allah and the Last Day. That is the best [way] and best in result.فَإِنْ تَنَازَعْتُمْ فِي شَيْءٍ فَرُدُّوهُ إِلَى اللَّهِ وَالرَّسُولِ إِنْ كُنْتُمْ تُؤْمِنُونَ بِاللَّهِ وَالْيَوْمِ الآخِرِ ذَلِكَ خَيْرٌ وَأَحْسَنُ تَأْوِيلا
[An-Nisa 4:59]
And Allah the Exalted said:
But no, by your Lord, they will not [truly] believe until they make you, [O Muhammad], judge concerning that over which they dispute among themselves and then find within themselves no discomfort from what you have judged and submit in [full, willing] submission.فَلا وَرَبِّكَ لاَ يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ ثُمَّ لاَ يَجِدُوا فِي أَنْفُسِهِمْ حَرَجًا مِمَّا قَضَيْتَ وَيُسَلِّمُوا تَسْلِيمًا
[An-Nisa 4:65]

Referring to judgment is to the Book of Allah the Exalted and to the Sunnah of the Messenger (peace and blessings be upon him). If one does not refer to them and considers it permissible to refer to other than them, he is a disbeliever. If he does not consider it permissible to refer to other than them, but he refers to other man-made laws out of greed for wealth, status, or position, then he is committing a sin and is an open sinner (fasiq) in a lesser degree of open sinfulness, and he does not exit the circle of faith. It is forbidden to live with a mushrik (one who associates partners with Allah) and to show him loyalty in the form of companionship and affection. However, being kind to a disbeliever and doing good to him is permissible if he is not a person at war, as Allah the Exalted said:
Allah does not forbid you from those who do not fight you because of religion and do not expel you from your homes - from being righteous toward them and acting justly toward them. Indeed, Allah loves those who act justly.لاَ يَنْهَاكُمُ اللَّهُ عَنِ الَّذِينَ لَمْ يُقَاتِلُوكُمْ فِي الدِّينِ وَلَمْ يُخْرِجُوكُمْ مِنْ دِيَارِكُمْ أَنْ تَبَرُّوهُمْ وَتُقْسِطُوا إِلَيْهِمْ إِنَّ اللَّهَ يُحِبُّ الْمُقْسِطِينَ
[Al-Mumtahanah 60:8]
. It is established from the Messenger (peace and blessings be upon him) that he ordered Asma bint Abi Bakr to maintain ties with her mother, who was a mushrik (one who associates partners with Allah), as narrated by the two Shaykhs (al-Bukhari and Muslim). As for the statement of the Shaykh al-Islam Ibn Taymiyyah and others, his intention was regarding people at war, not those under a treaty or the like. As for one who does not distinguish between the Jews and the Christians and other disbelievers and the Muslims except by nationality, and makes their rulings the same, he is a disbeliever. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
