The reader: "And Banu Makhzum were among the noblest clans of Quraysh, and it was severe for them that the hand of one of their women be cut off. So the Prophet (peace and blessings be upon him) made it clear that the destruction of the Children of Israel was only because the leaders of the people were given special exemption from punishments. He informed that if his daughter Fatimah—who is the noblest of women—had stolen, and Allah has protected her from that, her hand would have been cut off. This is to make clear that the obligation of justice and generality in hudud (fixed punishments) does not exclude the daughter of the Messenger, let alone the daughter of another. This agrees with what is in *the two Sahihs*, from Abdullah ibn Murrah from al-Bara' ibn 'Azib, who said: "

The reader: "He said: مُرَّ على النبي صلى الله عليه وسلم بيهودي، محمم مجلود، فدعاهم، فقال : هكذا تجدون حد الزاني في كتابكم ؟ قالوا : نعم . فدعا رجلا من علمائهم قال : أنشدك بالله الذي أنزل التوراة على موسى، أهكذا تجدون حد الزاني في كتابكم ؟ قال : لا، ولولا أنك نشدتني بهذا لم أخبرك، نجده : الرجم، ولكنه كثُر في أشرافنا، فكنا إذا أخذنا الشريف تركناه، وإذا أخذنا الضعيف أقمنا عليه الحد، فقُلنا : تعالوا فلنجتمع على شيء نقيمه على الشريف والوضيع، فجعلنا التحميم والجلد مكان الرجم فقال صلى الله عليه وسلم : اللهم إني أولُ من أحيا أمرك، إذ أماتوه . فأمر به فرجم، فأنزل الله عز وجل : يا أيها الرسول لا يحزُنك الذين يسارعون في الكفر إلى قوله : إن أوتيتم هذا فخذوه
يقول : ائتوا محمدا فإن أمركم بالتحميم والجلد فخذوه، وإن أفتاكم بالرجم فاحذروا، فأنزل الله تعالى : ومن لم يحكم بما أنزل الله فأولئك هم الكافرون ، ومن لم يحكم بما أنزل الله فأولئك هم الظالمون ، ومن لم يحكم بما أنزل الله فأولئك هم الفاسقون في الكفار كلها A Jew, branded and flogged, passed by the Prophet (peace and blessings be upon him). So he called them and said: "Is this what you find as the punishment for the fornicator in your Book?" They said: "Yes." So he called one of their scholars and said: "I invoke you by Allah who sent down the Torah upon Musa: Is this what you find as the punishment for the fornicator in your Book?" He said: "No, and were it not that you invoked me by this, I would not have informed you. We find: stoning. But it became common among our nobles, so when we took a nobleman, we left him, and when we took a weak one, we established the punishment upon him. So we said: Come, let us agree on something we establish for the noble and the lowly. So we made branding and flogging in place of stoning." Then the Prophet (peace and blessings be upon him) said: "O Allah, I am the first to revive Your command, when they had killed it." So he ordered him to be stoned. Then Allah the Exalted sent down: "O Messenger, let not those who hasten in disbelief grieve you" until His saying: "If this is given to you, then take it." He said: Come to Muhammad; if he commands you with branding and flogging, then take it, and if he issues a ruling for you with stoning, then beware. Then Allah the Exalted sent down: "And whoever does not judge by what Allah has revealed, then it is they who are the disbelievers," "And whoever does not judge by what Allah has revealed, then it is they who are the wrongdoers," "And whoever does not judge by what Allah has revealed, then it is they who are the wicked" in all the disbelievers.
