The Shaykh : Welcome to you.

The questioner : Shaykh Muhammad, we received a message from the Arab Republic of Egypt, sent by the correspondent or listener 'Abd al-Ghaffar Mahi al-Din. He asks: What is the ruling on one who neglects one of the pillars of Hajj, and what are those pillars? May Allah guide you.

The Shaykh : Praise be to Allah, Lord of the worlds, and may peace and blessings be upon our Prophet Muhammad, and upon his family and all his Companions. If one neglects one of the pillars of Hajj, it is either due to being prevented (husr) or for a reason other than being prevented. The meaning of being prevented is that a barrier stops a person from being able to complete his Hajj. If it is due to being prevented, he exits the state of ihram and slaughters his sacrificial animal if it is feasible.

The questioner : Yes.

The Shaykh : He shaves his head and his ritual is concluded. Then he must perform Hajj again from the beginning in the coming year if he had not yet fulfilled the obligatory duty. If he had already fulfilled the obligatory duty, the correct view is that it is not obligatory for him to repeat it, because this concerns the obligation of completion, and he was unable to do so due to the prevention that occurred. The obligatory duty is dropped when one is unable to fulfill it. However, if he had not fulfilled the obligatory duty, the obligation remains on his person, and he must fulfill it.

The questioner : Yes.

The Shaykh : This is if it was due to being prevented, based on the saying of Allah the Exalted:
And complete the Hajj and 'umrah for Allah. But if you are prevented, then [offer] what can be obtained with ease of sacrificial animals وأتموا الحج والعمرة لله فإن أحصرتم فما استيسر من الهدي
[Al-Baqarah 2:196]
. But if it was for a reason other than being prevented, meaning he left it without a valid excuse preventing him, then if that was standing at 'Arafah, his Hajj is not valid and not completed, based on the saying of the Prophet (peace and blessings be upon him):
Hajj is 'Arafah الحج عرفة

The Shaykh : And if it was the circumambulation (tawaf) or the walking between al-Safa and al-Marwah (sa'y), and tawaf and sa'y are among the pillars of Hajj, he must perform them, even if he is in his home country. It is obligatory for him to return and perform tawaf and sa'y to complete the pillars of his ritual. This is what pertains to the answer to the question.
