And his saying:
touches his private part, let him perform wudu مس ذكره فليتوضأ
The lam in his saying:
Let him perform ablution. فليتوضأ
is the lam of command, which conveys several benefits:
One of them is that if a man touches his private part, he is commanded to perform wudu, based on his saying:
Let him perform ablution. فليتوضأ
. Is this command for obligation or for recommendation?
It is possible that it is for obligation, and it is possible that it is for recommendation. I have started with the benefits, but in reality, we must explain before that:
His saying:
Whoever touches his private part من مس ذكره
Its apparent meaning is that there is no difference between touching it for desire or for other than desire, and between touching it intentionally or unintentionally, because a person might touch his private part unintentionally, such as if he intended to lift his lower garment or lift his trousers and touched it. This is unintentional. So the apparent meaning of the hadith is that there is no difference between intending it or not.
And it can be said: His saying:
Whoever touches من مس
is apparent in that the intended meaning is the intention to touch. But the jurists (may Allah have mercy on them), the Hanbali jurists, say: If he touches his private part, even if unintentionally, his wudu is invalidated.
And his saying:
Whoever touches his private part من مس ذكره

And his saying:
Let him perform ablution. فليتوضأ
only mentioned wudu, so istinja' (cleaning oneself) is not obligatory, because istinja' is only obligatory from urine or feces.
