The Shaykh : So we take the benefits from this hadith. Among the benefits is: the prohibition of prayer during these three times, with the exception of what was mentioned previously. Second: the prohibition of burying the dead during these three times. But if someone asks: What if we are compelled to bury during these three times, is it permissible? The answer is: Yes, if there is a dire necessity, such as the intense heat of the sun where the mourners cannot remain in the sun until it sets. I say: this is a dire necessity. Or if there is fear, or if there is fear that compels people to bury the deceased during these times, we say: there is nothing wrong with it. Or if there is rain. Pay attention to the example: is it valid or not valid? It is valid. Why? Because the times are with us, or otherwise, if there is rain and the sun is covered by clouds and not visible, but we say: this is known by the clock. We wait until we can determine that it has risen the length of a spear and that it has set in the late afternoon. And among the benefits of this hadith is: the permissibility of burying the deceased at any time other than these three times. The reason for this is that the prohibition of a specific thing indicates permissibility in everything other than that thing. So does its indication of the permissibility of burial at any time come from the meaning or the wording? The meaning. Good. Is burial at night permissible? Yes, burial at night is permissible because that is established by the Sunnah. The Prophet (peace and blessings be upon him) passed away on a Monday and was not buried until the night of Wednesday, at night. If it is said: Did the Prophet (peace and blessings be upon him) not warn against burying a man at night? We say: Yes, but for a reason. Because the man who died, and for whose sake the Prophet (peace and blessings be upon him) forbade the Companions from burying at night, died and they did not prepare his shroud properly, so there was a delay in something required. So if a person dies at night and we are unable to perform the washing that is required, or we do not find the shroud that is required, or something similar, then at that time we say: do not bury at night. But if the matters are available, as is the case in our current time, then there is nothing wrong with burial at night. If someone asks: What if heavy rains occur, do we have the right to delay? The answer is: Yes, we delay, because that leads to the people not burying him in the required manner. This is from one aspect. From another aspect, it leads to the grave filling with water, so it is delayed. And the conclusion is: that this hadith of Uqbah ibn 'Amir leads to the permissibility of burial at all times of the night and day, except for these three times. And from Rafi' ibn Khudayj (may Allah be pleased with him), he said: The Messenger of Allah (peace and blessings be upon him) said:
Offer Fajr prayer at dawn, for it is most productive of rewards to you أصبحوا بالصبح فإنه أعظم لأجوركم
