Then Allah, Blessed and Exalted is He, said: [An-Nisa 4:8] What appears to me, and knowledge is with Allah, from this verse and the one before it is that people in the past, when they intended to divide the deceased's wealth, would divide it openly and visibly, whether for people in general or visibly for those around them, based on His saying: [An-Nisa 4:8] We take the grammatical analysis first. [An-Nisa 4:8] is a fronted object, and is a delayed subject, raised by the waw because it is annexed to the plural of masculine sound nouns, and its nun was deleted due to the addition, is conjoined to , and is conjoined to . And His saying: is the answer to the conditional "if," and the faw is attached to it because it is a request, and the answer that is attached with the faw is of seven types, summarized in a verse of poetry:
Nominal request, with a static word, with "ma," with "qad," with "lan," and with the negation of the request
What type is the answer clause with us? It is a request.[An-Nisa 4:8] It is clear now. Allah, Mighty and Majestic, says: [An-Nisa 4:8] meaning the division of the inherited wealth. If they are present, meaning the relatives who do not inherit. We said "who do not inherit" because those who inherit have a share of this divided amount, but those who do not inherit, here means what? It means kinship. is the plural of "yateem" (orphan), which is one whose father died before he reached maturity. Before the maturity of whom? The father or the child? The child. One whose father died before he reached maturity, whether male or female. are the poor. They are called "masakin" (the poor) because poverty makes them dwell [in silence]. Indeed, poverty—may Allah protect us and you from it—necessitates humiliation and that a person does not speak, because he feels that he is not responsible and not accepted, so you find him silent and not speaking because he is not heard. But this poor person of ours may be heard. Sahih Muslim 2622 The whole matter is that you should be honorable in the sight of Allah. And if you are honorable in the sight of Allah, you will be honorable in the sight of the people. But do not seek to be honorable in the sight of Allah in order to be honorable in the sight of the people. Seek to be honorable in the sight of Allah to attain His pleasure, and if Allah is pleased with you, He will make the people pleased with you. He said: meaning give them, because "rizq" (provision) means giving. And His saying: and He did not say "in it," because these people are given from the head of the wealth, from the principal of the wealth. As for the wealth of orphans, Allah, the Exalted, said: And it has been mentioned to us before that He said: and He did not say "from it," because they are given after trading with it, so they are given from the profit, which is an indication of what was mentioned before that it is recommended for the guardian of the orphan to trade with his wealth so that he obtains what he can give from it. But here He said: meaning from this wealth that is being divided in front of them. [An-Nisa 4:5] Subhan Allah! Kindness to them in action and kindness in words. [An-Nisa 4:5] meaning a good word that pleases their souls. Let us suppose that the wealth is much and that every heir will receive, for example, one million riyals. If you give the poor person present one hundred riyals, he might say: "One hundred from a million?" Say to him a word of appropriate kindness that pleases his soul, so that you combine for him verbal kindness and practical kindness. The opposite—may Allah protect us from it—is one whose heart is stone; when he finds an orphan around him, he says: "What has this one come for? Go, seek provision from Allah." So his heart is not soft for the servants of Allah nor merciful to them. And a person must consider that if he were in this state, what would he do? He would look for something of this wealth and would see that one of the hardest things for him is to be turned away, especially if he is turned away to a group of people who are not known or recognized. Allah, Mighty and Majestic, says in this verse: [An-Nisa 4:8].
And when [other] relatives and orphans and the needy are present at the [time of] division, then provide for them [something] out of the estate
وإذا حضر القسمة أولوا القربى واليتامى والمساكين فارزقوهم منهAnd when [other] relatives and orphans and the needy are present at the [time of] division, then provide for them [something] out of the estate and speak to them words of appropriate kindness.
