The Shaykh : The question is: Does a disbeliever inherit from a Muslim? No, he does not inherit, that is the end of it. Since he does not inherit, he makes a bequest. However, the matter remains to be considered: Is it permissible for a person to be kind to a disbeliever? That is, is it permissible for me to be kind to a disbeliever? Allah the Exalted has detailed this in Surat al-Mumtahanah, and He said:
Allah does not forbid you from those who do not fight you because of religion and do not expel you from your homes - from being righteous toward them لا ينهاكم الله عن الذين لم يقاتلوكم في الدين ولم يخرجوكم من دياركم أن تبروهم
[Al-Mumtahanah 60:8]
This is excellence
and to be just to them وتقسطوا إليهم
This is dealing with justice. A person is not forbidden from dealing with a disbeliever with justice, or with generosity, on the condition that the disbeliever is not one of those who fight us in the religion.
