Question: If a man kills his brother and the father forgives this killer, does the killer inherit from the one who was killed?
Answer: The killer does not inherit from the one who was killed. If his killing was intentional and aggressive, he does not inherit from him. Likewise, if it was accidental and required him to pay blood money or an expiation, he does not inherit from him. This is based on the saying of the Prophet (peace and blessings be upon him):Bulugh al-Maram 7:218, and the scholars (may Allah have mercy on them) have reached consensus that the killer does not inherit from the one who was killed if his killing was aggressive.
However, if the remaining heirs allow him to share in the inheritance, there is no blame on them, provided they are accountable and guided, and they permit this killer to inherit with them, because the right belongs to them and they have waived it.
