The questioner : He says: I went out from my country to perform Hajj, and my brother sent with me the value of two Hajj pilgrimages on behalf of two people. I gave the amount to two people from the people of al-Madinah, and I do not know the individuals well. I said to the owner of the money, "I do not know anyone." He said, "Give it to anyone; it is on my guarantee, and your guarantee is clear." I ask for clarification. May Allah guide you.

The Shaykh : Praise be to Allah, Lord of the worlds, and may peace and blessings be upon our Prophet Muhammad, and upon his family and all his Companions. After that, the action of the agent is valid according to what the principal authorized him to do, provided it is not contrary to the Shari'ah. There is no blame on him, no guarantee on him, and no liability if he did not exceed what he was authorized to do. So, regarding these two Hajj pilgrimages, you have no liability. However, the liability may be on the one who said to you such absolute words, if the two Hajj pilgrimages were a bequest for a deceased person or for a living person who appointed you as his agent in that matter. Therefore, a person should be careful in selecting the trustworthiness and religion of the one he wants to perform Hajj on his behalf. For some people may not have mindfulness of Allah, mindfulness of Allah the Mighty and Majestic, nor mercy for His creation. They may take this money to perform Hajj with it, but they do not perform Hajj with it and instead spend it on whatever they desire from the adornments of this world. By doing so, they become traitors to their trust and fall into sin. Yes.
