The questioner : The listener from the news, M H M, from the Kingdom of Saudi Arabia, says: I appointed someone to perform Hajj on behalf of my deceased mother, and I heard that the person I gave money to to perform Hajj for her took other amounts to perform Hajj for other people. What is the ruling on this, O honorable Shaykh? And is this considered a complete Hajj, or must I perform Hajj in her place? Please give us a ruling, may Allah reward you.
The Shaykh : What a person should do is be decisive in his actions and not entrust the matter to anyone but a person in whom he has confidence in his religion, such that he is trustworthy and knowledgeable about what is required in such a task that has been delegated to him. If you want to give someone money to perform Hajj on behalf of your deceased father or mother, you must choose from among people someone in whom you trust his knowledge and his religion. This is because many people have great ignorance regarding the rulings of Hajj, so they do not perform Hajj as it should be, even if they are trustworthy in themselves. However, they think that this is what is obligatory upon them, and they err greatly. Such people should not be given the agency to perform Hajj due to their lack of knowledge. Some people have knowledge but do not have trustworthiness; you find that they do not care about what they say or do in the rituals of Hajj due to the weakness of their trustworthiness and religion. Such a person also should not be given the agency or entrusted with performing Hajj. Therefore, whoever wants to appoint someone to perform Hajj on his behalf must choose the best person he can find in terms of knowledge and trustworthiness, so that he performs what is requested of him in the most perfect manner.
As for this man whom the questioner mentioned, to whom he gave money to perform Hajj for his mother, and who later heard that he took other Hajj assignments for others, this needs to be looked into. Perhaps this man took these Hajj assignments from others and appointed people to perform them, while he himself performed the Hajj for the one who appointed him. But is it permissible for a person to do this? That is, is it permissible for a person to be appointed by multiple people for Hajj or 'Umrah, and then not perform it himself but delegate it to other people? We say that this is not permissible and is not lawful, and it is consuming wealth unjustly. For many people trade in this matter.
The questioner : Yes.
The Shaykh : You find them taking several Hajj and 'Umrah assignments, claiming that they are the ones who will perform them, but they delegate them to so-and-so and so-and-so among the people for less than what they took, thereby earning wealth unjustly. They give these Hajj or 'Umrah assignments to people who those who gave them the assignments may not approve of. So a person should fear Allah the Mighty and Majestic in his brothers and in himself, because if he takes such money, he has taken it without right. And because if he is trusted by his brothers that he is the one who will perform the Hajj, it is not permissible for him to delegate that to another, because that other person may not be approved of by those who gave him these Hajj or these 'Umrah assignments. Yes.
The questioner : May Allah bless you.
