The Shaykh : Among the benefits of this hadith are:
First: It is not permissible to sell fresh dates for dried dates, is that right? There is no difference between the fresh dates being on the tops of the palm trees or having been stripped, having been stripped and harvested. An exception to this is what we mentioned regarding al-'araya.
Now, regarding al-'araya, we mentioned five conditions, and we add a sixth condition: that the fresh dates must be on the tops of the palm trees. If they have been harvested, it is not valid. It is necessary that they be on the tops of the palm trees so that they can be harvested little by little.
Now, al-'araya is an exception to this, based on the indication of the Sunnah.
It is also derived from this: the consideration of avoiding riba, even in a distant manner, because the sale of fresh dates for dried dates, and raisins for grapes, and likewise crops for grain, is forbidden.
And among the benefits of the hadith is also: that it is not permissible to sell fresh dates for dry dates in what requires similarity, or is that not the case?
