Then, disbelief also—legal disbelief—may mean disbelief short of disbelief, meaning it is among the characteristics of disbelief and not all of it, such as his statement (peace and blessings be upon him):
Two things among the people are shirk, or by them is disbelief: slandering lineage and wailing over the dead. اثنتان من الناس بهما شرك ، أو بهما كفر ، الطعن في النسب والنياحة على الميت
And the meaning of:
And by them is disbelief. وبهما كفر
is that they are among the characteristics of disbelief. Shaykh al-Islam (may Allah have mercy on him) said in his book Iqtida' al-Sirat al-Mustaqim when he mentioned or pointed to the disbelief of the one who abandons prayer: "Indeed, the Prophet (peace and blessings be upon him and his family) said:
Between man and polytheism and unbelief بين الرجل وبين الشرك والكفر
