What is the ruling on the expiation for a man who was driving his car on a highway and was taking one of the lanes when a car overtook him from the right and entered in front of him

Machine translationRead the Arabic original
The questioner : A man was driving his car on a highway and was taking one of the lanes when a car overtook him from the right and entered in front of him, so it collided with him and the car overturned, and then three men died from this car and two remained alive, and one of them testified that the overtaking car was at fault because it overtook at high speed and its driver made a mistake when he entered in front of the car that hit them, so the court then ruled that the fault was with the driver who overtook and killed, and not with the driver who was driving on the far left. This driver asks whether this accidental killing that occurred without his intention requires him to bear the expiation by fasting two consecutive months for every soul killed in this accident, or whether he owes nothing as long as one of them testified that he is not at fault and the court acquitted him of it, and then the case was appealed again and the court’s ruling in the second instance confirmed its ruling in the first instance?

The Shaykh : In a case like this, it is not possible for people like us to issue a definitive ruling, but based on what you described regarding the court’s ruling, it appears that there is no expiation on him as long as he is considered the one who was encroached upon, is that clear?

The questioner: Yes.

The Shaykh : That is it.

The questioner : All right, if the matter were otherwise, if he were the one who encroached and made the mistake.

The Shaykh : He would have to pay the expiation, of course.

The questioner : Fasting two consecutive months for every soul.

The Shaykh : For each one, yes.

The questioner : Even if the number of souls reached ten?

The Shaykh : Even if.

The questioner : May Allah reward you.

The Shaykh : And may He reward you.
