Q: May Allah preserve the Shaykh, Abdul Aziz ibn Abdullah ibn Baz. Peace, mercy, and blessings of Allah be upon you. And after that:
I am a person who is owed a sum of money at the end of the tenth month, and I am unable to fulfill it in full on its due date. I have a sum of money for which I am the legal agent, and my father has a share of this amount.
My question: Is it permissible for me to deduct a portion of the zakat of this wealth to pay off my debt? Please issue a ruling for us, and may Allah reward you with the best reward.
A: And upon you be peace, and Allah’s mercy and blessings, and after that:
It is not permissible for you to do that. Rather, the zakat must be paid out by the owner of the wealth, unless your father and his partner have appointed you as their agent to pay out the zakat and distribute it to your creditors. In that case, there is no harm if you are unable to settle the rights of the creditors. May Allah reward you and every Muslim. Peace, mercy, and blessings of Allah be upon you.
