Question: Your Eminence, Shaykh 'Abd al-'Aziz ibn 'Abd Allah ibn Baz (may Allah preserve him).
Peace be upon you, and Allah’s mercy and blessings, and after that:
I am a person who is owed a sum of money at the end of the tenth month, and I am unable to fulfill it in full by its due date. I have a sum of money for which I am the agent under a legal agency, and my father has a share of this amount. My question is: Is it permissible for me to deduct a portion of the zakah of this wealth to pay off my debt? Please issue a ruling for us, and may Allah reward you with the best reward.

Answer: And upon you be peace, and Allah’s mercy and blessings, and after that:
It is not permissible for you to do so. Rather, the zakah must be paid out by the owner of the wealth, unless your father and his partner have appointed you as their agent to pay out the zakah and distribute it to your creditors. In that case, there is no harm if you are unable to settle the rights of the creditors. May Allah reward you and every Muslim. And peace be upon you, and Allah’s mercy and blessings.
