But there is no doubt that the intended meaning is one who is of age and sane, meaning the intended killer is the adult of sound mind. So it is a general statement intended for a specific case. What excluded the non-obligated? It excluded the non-adult and the non-sane. The other texts indicate this. Then his saying: indicates the exclusion of the child and the insane, because these people do not have intent or premeditation. This is the one who killed a believer. Look, "believer," and Allah the Exalted did not say "protected person," because there is a difference between the protected person and the believer. The protected person is of four types of humans: the Muslim, the dhimmi (a non-Muslim under Muslim protection), the mu'ahad (one with a treaty), and the musta'min (a non-Muslim granted safe conduct). All of these are protected. But the believer is protected without a cause; his blood and wealth are protected by his Islam. The dhimmi, the mu'ahad, and the musta'min must have contracts that are carried out between them and the Muslims, otherwise they are not protected.
Now, the one who kills a believer intentionally, his recompense is this great recompense: which is the Fire, meaning abiding in it.
