The Shaykh : First: I warn my Muslim brothers against being negligent in their religion and not caring about it, as they fall into many things that spoil worship and do not ask about them. Perhaps it remains for a year or two or more without being cared for, even though it is one of the obvious matters, but negligence or shynfulness or something similar prevents them. It is obligatory for one who wants to perform a type of worship, such as prayer, zakah, fasting, or Hajj, to know its rulings before worshipping Allah with knowledge. Allah Blessed and Exalted is He said:[Muhammad 47:19] Al-Bukhari (may Allah have mercy on him) said: "Knowledge before speech and action" Then he cited this verse as evidence.
Second: Regarding the question, we say that this woman is still in the remainder of her ihram because she did not complete the second release, as she performed tawaf while menstruating. The tawaf of a menstruating woman is defective, so she does not complete the second release until she completes the tawaf and sa'y along with the stoning and shortening of the hair. Therefore, we say that she must now avoid her husband if she is married, because she has not completed the second release. She should go to Makkah now, and when she reaches the miqat, she should enter ihram for 'Umrah, perform tawaf and sa'y, and shorten her hair, then perform the tawaf of ifadah that was required of her previously.
And if she prefers not to enter ihram for 'Umrah, there is nothing wrong with it, because she is still in the remainder of her first ihram. The important thing is that she must go and perform tawaf, because her Hajj has not been completed until now, and her husband should not approach her if she has married.
