Ruling on leasing agricultural land

Machine translationRead the Arabic original
Question: I have agricultural land in Sudan, and I was unable to cultivate it, so I considered leasing it to someone who could cultivate it. When I began to do so, I was informed by one of the jurists that leasing the land is not permissible, and that it is only permissible to give it in exchange for a share of the harvest. What is the ruling?

Answer: This statement is not correct; rather, it is permissible to lease it for a known amount of dirhams or the like. As Rafi' ibn Khadij (may Allah be pleased with him) said when he was informed of the Prophet's (peace and blessings be upon him) prohibition of leasing land for unknown types of rent:
But if there is something definite and reliable (e. g. money). there is no harm in it.فأما شيء معلوم مضمون فلا بأس به
Sahih Muslim 1547l
. It is also permissible to lease land for a known, undivided share of what it produces, such as a quarter, a third, or the like.
