Q1: What is the Islamic ruling regarding leasing agricultural land, is the rent to be paid by the lessee to the lessor from the produce according to what they agree upon, or is it permissible for the rent to be a fixed sum of money, whether the lessee profits or loses?
A1: It is permissible to lease agricultural land for a shared portion of its produce, such as one-third or one-quarter. If he plants it, the rent is taken from the produce. If he does not plant it without a valid Islamic excuse, the average yield is considered, and the specified share becomes obligatory. One looks at how much the yield would be with high quality; for example, it is said: “Five thousand.” Then it is asked: “And with medium quality?” It is said: “Four thousand.” Then it is asked: “And with poor quality?” It is said: “Three thousand.” The result is that the landowner is owed the specified portion of four thousand, which is the medium yield. Likewise, it is permissible to lease agricultural land for a fixed sum of money, which the person leasing it pays, whether he plants it or not.
