Q: I have a piece of land, and I had agreed with one of the local banks that deals in riba (usury or interest) to lease this land to them for a long period for the purpose of establishing a branch. After reviewing a religious ruling issued by the Permanent Committee for Scholarly Research and Ifta that does not permit leasing such land to banks (Fatwa number 20507) dated 3/8/1419 AH, I decided to withdraw from leasing this land to the bank. A person who has a connection with that bank contacted me and offered to lease this land in his name for the same period. I learned from him that he intends to lease the land from himself to the bank, without any relationship between the landowner and the bank. This person also offered to buy the land in his name if I did not wish to lease it. I also learned from him that he intends to lease the land to the bank or sell it to them to establish a bank branch on it. Is it permissible for me, without any religious prohibition, to sell this land or to
lease it to this person according to my choice, either by sale or by lease, knowing that this person will lease this land to the bank or sell it to them to establish a bank branch on it? I ask you to inform me of the religious perspective in both cases, leasing or selling. May Allah guide you.

A: It is not permissible to sell or lease a place to one who uses it to disobey Allah the Exalted, such as dealing in riba (usury or interest), based on the saying of Allah the Exalted:
And cooperate in righteousness and piety, but do not cooperate in sin and aggression. And fear Allah; indeed, Allah is severe in penalty.وَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَى وَلاَ تَعَاوَنُوا عَلَى الإِثْمِ وَالْعُدْوَانِ وَاتَّقُوا اللَّهَ إِنَّ اللَّهَ شَدِيدُ الْعِقَابِ
[Al-Ma'idah 5:2]
, whether directly or indirectly, if you are certain of that. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
