Question: From Abdulaziz ibn Abdullah ibn Baz to the honorable brother, the esteemed judge of the Fursan Court, may Allah grant him understanding in all good, amen.
Peace be upon you, and Allah's mercy and blessings. After that:
O Beloved, your noble letter number (134), dated 2/7/1398 AH, has arrived, may Allah guide you and inform you of what is therein. I have reviewed the attached document certified by your eminence, in which the husband states that a dispute occurred between him and his wife, leading her to leave for her father's house. He followed her in order to bring her back to his home, so she swore that she would not return to it. Upon this, he became extremely angry and divorced her by saying to her: "Divorced, divorced, divorced." He states that he intended by this repetition to confirm the divorce, and that he did not divorce her before or after that. The document also contains his wife's confirmation of the nature of the event and that he did not divorce her before or after that, in the presence of her brother.

Answer: I inform you that based on this, I issued a fatwa to the husband that one divorce has taken effect on his wife through the divorce mentioned above. The second and third expressions of divorce are considered confirmations of the first expression, and no divorce takes effect by them, as the scholars have stated in the chapter on what differentiates the number of divorces. She owes an expiation for the oath if she returns to his home, provided it is not known which of them was in the wrong. I ask your eminence to inform everyone of the aforementioned fatwa. May Allah reward you and thank you for your efforts.
