Question: The husband, F. A. '., came to me with his wife and her brother, M. M. The husband stated that a dispute and quarrel had occurred between him and his aforementioned wife, and he divorced her by saying: "Talaq, talaq, talaq," while in a state of extreme anger, because she had broken the video and the watch she was wearing. Then, after two or three days, some of her brothers came to him along with two others, and they discussed the matter of the disagreement between the spouses. They asked him to divorce her, so he became angry and wrote a paper stating: "I have divorced her with a valid, binding Islamic divorce from which there is no return." When asked about his intention, he stated that he intended the previous divorce. The husband and wife also stated that the aforementioned wife was menstruating at the time of the divorce he pronounced verbally and the one he wrote in the paper afterwards.

Answer: Based on all of this, I issued a fatwa to the aforementioned husband that the divorce mentioned did not take place and his wife remains in his protection; because it occurred in a state of extreme anger and while the woman was menstruating. The scriptural evidence indicates that divorce does not take place in the two aforementioned states.
