Dear Beloved: Your noble letter dated 10/6/1390 AH has reached you, may Allah guide you, and I have reviewed the attached sheet, which contains your confirmation of the nature of the divorce pronounced by the husband, S. 'A. A., on his wife. He divorced his aforementioned wife by saying to her: "You are divorced with three divorces." It was ruled in the court of Massawa that he must feed sixty poor people, amounting to sixty riyals. He took her back after one week of the divorce taking place, in the presence of her father and her maternal uncle, before the judge of Massawa. However, he was unable to provide the feeding at that time. He is now able to provide the feeding, but he is still separated from his aforementioned wife. He had not divorced her before this, and she has no guardian in the Kingdom, and his wife has confirmed this to him.
Answer: Based on this, I have issued a ruling to the aforementioned husband that one divorce has taken effect on his aforementioned wife through the divorce mentioned, and his taking her back is valid, and he owes no expiation; because there is no basis for an expiation in such an incident, and we do not know of any scholar who has said so—if the reality is as stated. It is authentically reported from the Prophet (peace and blessings be upon him) what indicates the aforementioned ruling.
I hope you will inform the aforementioned man and his wife of this, and order him to repent from his divorce; because it is contrary to the Sunnah. May Allah reward you, and thank you for your efforts.
