Question: The husband came to me, accompanied by his brother-in-law (his wife’s brother), and the husband’s mother and his wife were also present. The husband admitted that he had divorced his wife with three divorces in a single utterance on Saturday, corresponding to 18/3/1393 AH. He had previously divorced her once in 1392 AH, then taken her back. When his brother-in-law and the husband’s mother were asked, they answered that the situation was as the husband stated. As for the wife, they all stated that she is deaf and cannot hear. When the husband’s mother asked her by gesture, in the presence of the aforementioned individuals, she answered that she did not know.

Answer: Based on this, I issued a ruling to the husband that the last divorce counted as one divorce, which is added to the previous divorce, leaving her with one divorce remaining. He may take her back as long as she is in the waiting period; because it is authentically reported from the Prophet (peace and blessings be upon him) what indicates this. The husband took her back in my presence, in the presence of her brother and I. A. H. Thus, the wife remained in his marriage bond.
