The bequest is executed as long as it is within one-third or less

Question: My father left us an inheritance after his death. Among the inheritance is a building that he bequeathed to be sold, and a mosque to be built with its price. We assessed the estate and found that the building is less than one-third. A relative suggested that he take responsibility for building the mosque in exchange for the building, or that he buy it and pay the price in installments. What is your opinion, Your Eminence?

Answer: You must execute it; you must carry out what your father bequeathed, as long as the building is one-third or less. You must execute it and build the mosque he bequeathed. If there is a specific location, build it there; otherwise, build a mosque in any location. Spend the value of the building on building a mosque that people need, that the residents of the neighborhood need, or entrust this matter to this trustworthy and honest man so that he fulfills the obligation. Do not be lax in this matter. Rather, the building must be sold and its price spent on building the mosque in a suitable place where its residents need a mosque. Do not sell it in installments; sell it for a lump sum; that is, sell it for a price paid in advance, so that you expedite the execution of what your father said. Spend its price on building the mosque, and do not sell it in installments.
