Question:
Shaykh al-Islam Ibn Taymiyyah was asked, as recorded in Majmu' al-Fatawa, about a man who missed the 'Asr prayer and came to the mosque to find that Maghrib had been called. Should he pray the missed prayer before Maghrib, or not?
He (may Allah have mercy on him) said: Rather, he should pray Maghrib with the imam, then pray 'Asr, as agreed upon by the scholars. Then he (may Allah have mercy on him) mentioned the scholars' disagreement regarding repeating Maghrib after praying 'Asr. Is the answer of Shaykh al-Islam correct or not?
If it is correct, how is it derived? It is known that the order of prayers is obligatory.

Answer:
His (may Allah have mercy on him) intention is that he prays a voluntary prayer with the imam for Maghrib; based on the saying of the Prophet (peace and blessings be upon him): "If the call to prayer is made and you are in the mosque, pray with them. Do not say, 'I have already prayed,' and not pray. Pray with them." Some scholars said: It suffices even if you perform it before 'Asr. Some said: No, he should pray it as a voluntary prayer, not sit while people are praying, then pray Maghrib after he has prayed 'Asr; so that the order is achieved. This is the correct view: he prays 'Asr, then prays Maghrib. If he arrives while they are in Maghrib, he prays a voluntary prayer with them so that he does not sit while people are praying. If he prays it with the intention of 'Asr and adds one unit, it appears that it suffices for him; because the intention does not affect the matter as long as the action is completed. Praise be to Allah.
But for him to pray a voluntary prayer with them, then pray 'Asr, then pray Maghrib after that; this is the obligatory way; because Allah ordered them in this manner. And if he prays 'Asr alone, then joins them in Maghrib and extends it, there is no harm.
