Answer:
A disbeliever has no guardianship. However, if it is absolutely necessary and she has no guardian, it is more appropriate for him to take charge of the matter so that no fitnah (trial, discord or temptation) occurs. In reality, she is marrying herself, but she should consult with him so that no fitnah arises between him and the husband, and so that no harm occurs among them out of dire necessity. Otherwise, he is not a legitimate guardian in the Shari'ah.
